How does it work?

Step 1 Send us your trade mark name, slogan or logo. We will verify that the name is capable of being registered as a trade mark and that it has not already been registered. 

Step 2 We will then draft your filing to include the goods and services required for your business in the most cost effective way. 

Step 3 We will file your mark for examination. Government filing fees are paid at this point. 

Step 4 The trade mark examiner will publish your trade mark. Once passed the publication period you will become the registered owner of the trade mark. 

Timelines

The duration of the procedure depends on the individual case. Applications that are seemingly straightforward are examined within six working days and registered after payment of the filing fees and any class surcharges (see early trade mark examination and this chart). All other applications are examined generally within 5 months after payment of the filing fee and any class surcharges. Within this time limit, we will either confirm that your trade mark is to be accepted for registration in the trade mark register or inform you of any deficiencies which you can subsequently remedy within a given time limit.

It is possible to request an expedited examination. This guarantees that your trade mark will be registered or an objection letter will be sent within one month and that the remaining procedural steps will completed within 2 months. The expedited examination is subject to a fee.
